# Federal Rule of Criminal Procedure 45

## Propositions supported

- Rule 45(a)(1) controls computation of periods stated in days.
- Rule 45(b)(1) governs extensions before and after a deadline.
- Rule 45(b)(2)'s current exception names Rule 35, not Rule 33.

## Material limitations

Whether excusable neglect is established is fact-specific and governed by controlling precedent. This card does not supply a nationwide application test.
