# Federal Rules of Criminal Procedure 5 and 5.1

## Propositions supported

Rules 5 and 5.1 govern federal initial-appearance timing and location, the prompt complaint after a warrantless arrest, felony advisements, counsel consultation, release or detention referral, and the conditional preliminary-hearing right and deadlines.

## Material limitations

Rule 5 says “without unnecessary delay”; it does not create a 48-hour presentment rule. The Judiciary's current-rules page was checked on August 25, 2026; no post-2024 criminal-rule amendment affecting Rules 5 or 5.1 was identified.
