# Burks v. United States

## Holding used

An appellate determination of evidentiary insufficiency requires acquittal and bars retrial, while ordinary trial-error reversal permits retrial.

The challenged ruling must be correctly classified; not every reversal, dismissal, or new-trial order is an insufficiency acquittal.
