# Evans v. Michigan

## Holding used

A substantive insufficiency ruling is an acquittal and bars retrial even when based on an erroneously added element; labels do not control.

## Material limitation

The ruling must actually resolve criminal liability on insufficiency grounds rather than correct an ordinary procedural or trial error.
