# D.C. Circuit Overlay

This page prevents nationwide rules from being mistaken for D.C. Circuit doctrine and prevents unresearched circuit law from being guessed. It is a bounded overlay, not an exhaustive treatise or a substitute for the current docket, published opinions, local rules, or citator.

## Official rule source and currency

- [Official D.C. Circuit rules and procedures](https://www.cadc.uscourts.gov/sites/cadc/files/rules-RulesFRAP20251204.pdf)
- Official circuit rules amended December 4, 2025 and FRAP through December 1, 2025 checked on 2026-08-25.
- Source authority: `AUTH-CADC-LOCAL-RULES`.
- A portal check does not prove that no issue-specific local rule exists. Open the current rule, amendments, internal operating procedures, and standing orders for the actual filing.

## Verified circuit holdings

<!-- claim:CLM-CIRDC-001 authorities:AUTH-PL-115-391-SEC-404,AUTH-SCOTUS-CONCEPCION-597-US-481,AUTH-CADC-LAWRENCE-1-F4TH-40,AUTH-CADC-SMITH-104-F4TH-314 status:verified_current -->
- **CLM-CIRDC-001:** In the D.C. Circuit, § 404 does not create a categorical right to allocution before decision; after Concepcion, review of the discretionary ruling is not overly searching absent legal error, a sentence above the revised maximum does not itself compel reduction, and a sufficiently reasoned record can sustain denial. [*United States v. Lawrence*, 1 F.4th 40, 46–48 (D.C. Cir. 2021)](https://media.cadc.uscourts.gov/opinions/docs/2021/06/20-3061-1902399.pdf); [*United States v. Smith*, 104 F.4th 314, 333–35 (D.C. Cir. 2024)](https://media.cadc.uscourts.gov/opinions/docs/2024/06/22-3033-2059841.pdf)

  Limitation: Binding only in the D.C. Circuit. Lawrence addresses no categorical allocution right, while Smith supplies the current post-Concepcion review and explanation rules; neither guarantees relief or eliminates case-specific procedural requirements.
<!-- claim:CLM-CIRDC-002 authorities:AUTH-USC-28-2253,AUTH-CADC-SUGARMAN-170-F3D-1145,AUTH-CADC-MADLEY-278-F3D-1306 status:verified_current -->
- **CLM-CIRDC-002:** In the D.C. Circuit, a federal prisoner proceeding under § 2241 does not need a certificate of appealability, but a person detained under D.C. Superior Court process is treated as detained pursuant to state-court process for § 2253(c)(1)(A) and does need one. [*Sugarman v. Pitzer*, 170 F.3d 1145, 1146 (D.C. Cir. 1999)](https://media.cadc.uscourts.gov/opinions/docs/1999/04/98-5522a.txt); [*Madley v. U.S. Parole Commission*, 278 F.3d 1306, 1310 (D.C. Cir. 2002)](https://openjurist.org/278/f3d/1306/madley-v-united-states-parole-commission)

  Limitation: Binding only in the D.C. Circuit. The custody-producing court controls this distinction: Sugarman addresses federal process, while Madley treats D.C. Superior Court process as state-court process for § 2253(c)(1)(A). Filing classification remains separate.
<!-- claim:CLM-CIRDC-003 authorities:AUTH-USC-18-3582-3583,AUTH-CADC-WILSON-77-F4TH-837 status:verified_current -->
- **CLM-CIRDC-003:** In the D.C. Circuit, § 3582(c)(1)(A)'s defendant-filing prerequisite is a nonjurisdictional claim-processing rule; the court expressly declined to decide whether each ground later presented in court must first have been presented to the warden. [*United States v. Wilson*, 77 F.4th 837, 842–45 (D.C. Cir. 2023)](https://www.govinfo.gov/content/pkg/USCOURTS-caDC-21-03074/pdf/USCOURTS-caDC-21-03074-0.pdf)

  Limitation: Binding only in the D.C. Circuit. Wilson assumed issue exhaustion without deciding it. Its separate change-in-law eligibility analysis is not adopted here and must be assessed under current Supreme Court law and the current Sentencing Guidelines.
<!-- claim:CLM-CIRDC-004 authorities:AUTH-USC-18-3582-3583,AUTH-CADC-MATHIS-GARDNER-783-F3D-1286 status:verified_current -->
- **CLM-CIRDC-004:** In the D.C. Circuit, a court must consider the specified § 3553(a) factors before granting or denying early termination, but a denial needs no standalone explanation if the court's reasoning is discernible from the record. [*United States v. Mathis-Gardner*, 783 F.3d 1286, 1287–90 (D.C. Cir. 2015)](https://media.cadc.uscourts.gov/opinions/docs/2015/04/14-3031-1548331.pdf)

  Limitation: Binding only in the D.C. Circuit. Mathis-Gardner does not require findings on every factor or relief on the merits; an unexplained order is sustainable only when the record makes the reasoning discernible.
<!-- claim:CLM-CIRDC-005 authorities:AUTH-USC-28-1651,AUTH-USC-28-2255,AUTH-CADC-AYALA-894-F2D-425 status:verified_current -->
- **CLM-CIRDC-005:** In the D.C. Circuit, audita querela cannot rest on pure equity and, if it survives at all, can reach only a legal objection not cognizable through existing federal postconviction remedies; a claim cognizable under § 2255 belongs there. [*United States v. Ayala*, 894 F.2d 425, 427–30 (D.C. Cir. 1990)](https://www.courtlistener.com/opinion/535569/united-states-v-wilfredo-felix-ayala/)

  Limitation: Binding only in the D.C. Circuit. Ayala did not definitively decide whether the writ survives, rejected an immigration-consequence equity theory, and remanded for treatment under § 2255 without deciding the constitutional merits.

## Circuit-sensitive issue register

Each row records the nationwide floor, the circuit rule actually verified or the exact missing source, intra-circuit conflict status, publication status, relevant local-rule source, inter-circuit comparison, current-split status, and the check date. “Not verified” is a stop condition, not an invitation to infer the rule.

| Issue | Supreme Court or nationwide floor | D.C. Circuit rule | Intra-circuit conflict | Publication status | Relevant local rule | Conflicting circuits / current split | Last checked |
|---|---|---|---|---|---|---|---|
| § 2241 administrative exhaustion | Section 2241 contains no general exhaustion clause; 28 C.F.R. part 542 defines the BOP remedy path. The character, waiver, and exceptions require controlling circuit law. | Not verified: a bounded public-source search did not locate an exact published D.C. Circuit formulation for administrative exhaustion of a federal BOP § 2241 claim. | No intra-circuit conflict established in this bounded review; absence is not asserted. | not_verified | [Official D.C. Circuit rules source](https://www.cadc.uscourts.gov/sites/cadc/files/rules-RulesFRAP20251204.pdf); no issue-specific local-rule absence is asserted. | No D.C. Circuit proposition is inferred from district decisions, PLRA cases, immigration cases, or opinions that expressly declined to decide exhaustion. | 2026-08-25 |
| COA for a federal § 2241 appeal | Section 2253(c) identifies the proceedings for which a COA is required; custody source and proceeding classification control. | *Sugarman v. Pitzer*, 170 F.3d 1145, 1146 (D.C. Cir. 1999), and *Madley v. U.S. Parole Commission*, 278 F.3d 1306, 1310 (D.C. Cir. 2002): no COA for federal-process § 2241, but a COA is required for D.C. Superior Court process. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official D.C. Circuit rules source](https://www.cadc.uscourts.gov/sites/cadc/files/rules-RulesFRAP20251204.pdf); no issue-specific local-rule absence is asserted. | The custody-producing court controls; the § 2241 label alone does not answer the COA question. | 2026-08-25 |
| First Step Act § 404 procedure and review | Concepcion and § 404 supply the nationwide floor, but hearing, presence, explanation, preservation, and review rules may require circuit authority. | *United States v. Lawrence*, 1 F.4th 40, 46–48 (D.C. Cir. 2021), and *United States v. Smith*, 104 F.4th 314, 333–35 (D.C. Cir. 2024): no categorical allocution right; post-Concepcion review is deferential absent legal error, and a sufficiently reasoned record can sustain denial. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official D.C. Circuit rules source](https://www.cadc.uscourts.gov/sites/cadc/files/rules-RulesFRAP20251204.pdf); no issue-specific local-rule absence is asserted. | Lawrence supplies only the allocution proposition; Smith supplies the current post-Concepcion explanation and review rules. | 2026-08-25 |
| § 3582 issue presentation, reconsideration, and appeal | Section 3582(c), Rule 43, and Appellate Rule 4 supply text; issue exhaustion, reconsideration, waiver, and remedy remain posture- and circuit-sensitive. | *United States v. Wilson*, 77 F.4th 837, 842–45 (D.C. Cir. 2023): nonjurisdictional claim-processing rule; issue exhaustion was expressly left undecided. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official D.C. Circuit rules source](https://www.cadc.uscourts.gov/sites/cadc/files/rules-RulesFRAP20251204.pdf); no issue-specific local-rule absence is asserted. | No issue-exhaustion rule or change-in-law eligibility rule is adopted from Wilson. | 2026-08-25 |
| § 3583(e) modification and early termination | Section 3583(e) supplies eligibility, factors, and authorized actions; explanation, changed-circumstance, hearing, review, and collateral-attack rules may differ by circuit. | *United States v. Mathis-Gardner*, 783 F.3d 1286, 1287–90 (D.C. Cir. 2015): factor consideration is mandatory, but a denial needs no standalone explanation when the reasoning is discernible from the record. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official D.C. Circuit rules source](https://www.cadc.uscourts.gov/sites/cadc/files/rules-RulesFRAP20251204.pdf); no issue-specific local-rule absence is asserted. | No merits entitlement or fixed explanation length is created. | 2026-08-25 |
| Audita querela and other residual writs | The All Writs Act and Supreme Court limits supply the nationwide floor; any surviving elements test and remedial gap require current circuit authority. | *United States v. Ayala*, 894 F.2d 425, 427–30 (D.C. Cir. 1990): pure equity is insufficient and, if the writ survives, only a legal objection outside existing remedies could qualify; § 2255 claims belong under § 2255. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official D.C. Circuit rules source](https://www.cadc.uscourts.gov/sites/cadc/files/rules-RulesFRAP20251204.pdf); no issue-specific local-rule absence is asserted. | Ayala did not finally decide survival and did not decide the merits of the recharacterized constitutional claims. | 2026-08-26 |

## Application controls

1. Classify the judgment, custody source, motion, court, requested relief, and appellate posture before selecting an overlay row.
2. Use only a verified published circuit holding for a circuit proposition; do not promote a district opinion, unpublished disposition, dicta, or a party's characterization into binding law.
3. Run a current citator and check en banc, Supreme Court, statutory, rule, and local-rule changes before filing.
4. Preserve issue presentation, objections, the operative record, deadline trigger, and the governing standard of review.
5. If the issue register says `not_verified`, use the linked nationwide module only for its bounded nationwide proposition and obtain the missing controlling authority.

## Coverage and limitations

- Canonical overlay claims on this page: `CLM-CIRDC-001, CLM-CIRDC-002, CLM-CIRDC-003, CLM-CIRDC-004, CLM-CIRDC-005`.
- Comprehensive commercial citator: **not run**.
- Individual docket, judgment, custody, and administrative record: **not reviewed**.
- Issue-specific local-rule absence: **not asserted**.
- Unverified rows are included in the coverage matrix and therefore the generated Jira backlog.
