# First Circuit Overlay

This page prevents nationwide rules from being mistaken for First Circuit doctrine and prevents unresearched circuit law from being guessed. It is a bounded overlay, not an exhaustive treatise or a substitute for the current docket, published opinions, local rules, or citator.

## Official rule source and currency

- [Official First Circuit rules and procedures](https://www.ca1.uscourts.gov/local-rules)
- Official rules portal and rulebook effective through June 1, 2026 checked on 2026-08-25.
- Source authority: `AUTH-CA1-LOCAL-RULES`.
- A portal check does not prove that no issue-specific local rule exists. Open the current rule, amendments, internal operating procedures, and standing orders for the actual filing.

## Verified circuit holdings

<!-- claim:CLM-CIR1-001 authorities:AUTH-CA1-ROGERS-180-F3D-349 status:verified_current -->
- **CLM-CIR1-001:** In the First Circuit, a federal sentence-credit request under 18 U.S.C. § 3585(b) must first be presented to the Bureau of Prisons; after administrative exhaustion, the prisoner may seek review of the BOP determination through § 2241. [*Rogers v. United States*, 180 F.3d 349, 357–58 (1st Cir. 1999)](https://www.courtlistener.com/opinion/198520/rogers-v-united-states/)

  Limitation: Binding only in the First Circuit and limited to BOP sentence-credit computation. Rogers does not supply a general catalog of exhaustion exceptions or characterize every § 2241 exhaustion rule.
<!-- claim:CLM-CIR1-002 authorities:AUTH-PL-115-391-SEC-404,AUTH-SCOTUS-CONCEPCION-597-US-481,AUTH-CA1-RODRIGUEZ-REYES-23-2037 status:verified_current -->
- **CLM-CIR1-002:** In the First Circuit, appellate review of a First Step Act § 404 ruling is deferential absent a legal benchmark error; the district court may explain its exercise of discretion briefly, and the explanation may be understood from the full record, but it must show consideration of the parties' nonfrivolous arguments. [*United States v. Rodríguez-Reyes*, No. 23-2037, slip op. at 9–15 (1st Cir. June 10, 2026)](https://www.ca1.uscourts.gov/sites/ca1/files/opnfiles/23-2037P-01A.pdf)

  Limitation: Binding only in the First Circuit. Rodríguez-Reyes does not require a detailed rebuttal to every argument or a sentence reduction, and the adequacy of an explanation remains record dependent.
<!-- claim:CLM-CIR1-003 authorities:AUTH-USC-28-2253,AUTH-CA1-BARRETT-178-F3D-34 status:verified_current -->
- **CLM-CIR1-003:** In the First Circuit, the certificate-of-appealability and appellate preclearance requirements do not directly apply to a federal prisoner's claim that actually proceeds under § 2241; whether a filing is properly classified under § 2241 rather than § 2255 remains a separate question. [*United States v. Barrett*, 178 F.3d 34, 42 (1st Cir. 1999)](https://www.courtlistener.com/opinion/198488/united-states-v-barrett/)

  Limitation: Binding only in the First Circuit and limited to the COA consequence after correct classification. Barrett involved alternative § 2255, § 2241, and All Writs Act theories; no saving-clause merits rule is adopted, and current filing-office instructions should be checked before filing.
<!-- claim:CLM-CIR1-004 authorities:AUTH-USC-18-3582-3583,AUTH-CA1-TEXEIRA-NIEVES-23-F4TH-48 status:verified_current -->
- **CLM-CIR1-004:** In the First Circuit, § 3582(c)(1)(A)'s defendant-filing prerequisite is a nonjurisdictional claim-processing rule; the court has expressly left unresolved whether, and to what extent, a defendant must present each ground to the warden before relying on it in court. [*United States v. Texeira-Nieves*, 23 F.4th 48, 52–53 (1st Cir. 2022)](https://www.ca1.uscourts.gov/sites/ca1/files/opnfiles/21-1034P-01A.pdf)

  Limitation: Binding only in the First Circuit. Texeira-Nieves assumed issue exhaustion rather than deciding it; this claim does not establish which factual or legal grounds must match the warden request, and it does not adopt the opinion's superseded discussion of the former policy-statement landscape.
<!-- claim:CLM-CIR1-005 authorities:AUTH-USC-18-3582-3583,AUTH-CA1-DAMARIO-412-F3D-253 status:verified_current -->
- **CLM-CIR1-005:** In the First Circuit, a pending appeal from a supervised-release revocation does not divest the district court of its continuing § 3583(e)(2) authority to modify release conditions during the term of supervision. [*United States v. D'Amario*, 412 F.3d 253, 255–56 (1st Cir. 2005)](https://www.ca1.uscourts.gov/sites/ca1/files/opnfiles/04-2566-01A.pdf)

  Limitation: Binding only in the First Circuit and limited to continuing modification jurisdiction while a revocation appeal was pending. D'Amario does not establish an early-termination standard, a changed-circumstances rule, or a universal hearing rule.
<!-- claim:CLM-CIR1-006 authorities:AUTH-USC-28-1651,AUTH-CA1-HOLDER-936-F2D-1 status:verified_current -->
- **CLM-CIR1-006:** In the First Circuit, assuming audita querela survives in federal criminal cases, it can address only a legal objection arising after conviction that is not redressable through another postconviction remedy; equitable hardship alone is insufficient. [*United States v. Holder*, 936 F.2d 1, 2–5 (1st Cir. 1991)](https://www.courtlistener.com/opinion/563216/united-states-v-ewart-mark-holder/)

  Limitation: Binding only in the First Circuit. Holder expressly did not decide whether audita querela survives; it rejected a pure-equity immigration-consequence theory and did not identify any actual remedial gap. Section 2255 classification and the current nationwide limits, including Jones v. Hendrix, still must be applied independently.

## Circuit-sensitive issue register

Each row records the nationwide floor, the circuit rule actually verified or the exact missing source, intra-circuit conflict status, publication status, relevant local-rule source, inter-circuit comparison, current-split status, and the check date. “Not verified” is a stop condition, not an invitation to infer the rule.

| Issue | Supreme Court or nationwide floor | First Circuit rule | Intra-circuit conflict | Publication status | Relevant local rule | Conflicting circuits / current split | Last checked |
|---|---|---|---|---|---|---|---|
| § 2241 administrative exhaustion | Section 2241 contains no general exhaustion clause; 28 C.F.R. part 542 defines the BOP remedy path. The character, waiver, and exceptions require controlling circuit law. | *Rogers v. United States*, 180 F.3d 349, 357–58 (1st Cir. 1999): a § 3585(b) sentence-credit request goes first to BOP; after exhaustion, review proceeds under § 2241. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official First Circuit rules source](https://www.ca1.uscourts.gov/local-rules); no issue-specific local-rule absence is asserted. | Posture-limited BOP sentence-credit rule; no general First Circuit exception taxonomy is claimed. | 2026-08-25 |
| COA for a federal § 2241 appeal | Section 2253(c) identifies the proceedings for which a COA is required; custody source and proceeding classification control. | *United States v. Barrett*, 178 F.3d 34, 42 (1st Cir. 1999): COA and appellate preclearance requirements do not directly apply to a federal prisoner's claim actually proceeding under § 2241. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official First Circuit rules source](https://www.ca1.uscourts.gov/local-rules); no issue-specific local-rule absence is asserted. | Mixed alternative-posture holding; no saving-clause merits proposition is adopted, and current clerk instructions should be checked. | 2026-08-25 |
| First Step Act § 404 procedure and review | Concepcion and § 404 supply the nationwide floor, but hearing, presence, explanation, preservation, and review rules may require circuit authority. | *United States v. Rodríguez-Reyes*, No. 23-2037, slip op. at 9–15 (1st Cir. June 10, 2026): deferential review absent legal benchmark error; a brief explanation understood from the full record may suffice if nonfrivolous arguments were considered. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official First Circuit rules source](https://www.ca1.uscourts.gov/local-rules); no issue-specific local-rule absence is asserted. | No detailed rebuttal to every argument is required; adequacy remains record dependent. | 2026-08-25 |
| § 3582 issue presentation, reconsideration, and appeal | Section 3582(c), Rule 43, and Appellate Rule 4 supply text; issue exhaustion, reconsideration, waiver, and remedy remain posture- and circuit-sensitive. | *United States v. Texeira-Nieves*, 23 F.4th 48, 52–53 (1st Cir. 2022): the filing prerequisite is nonjurisdictional; the court assumed, without deciding, whether issue exhaustion applies. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official First Circuit rules source](https://www.ca1.uscourts.gov/local-rules); no issue-specific local-rule absence is asserted. | No issue-exhaustion rule is inferred from the court's assumption; the merits and former policy-statement discussion are outside this row. | 2026-08-25 |
| § 3583(e) modification and early termination | Section 3583(e) supplies eligibility, factors, and authorized actions; explanation, changed-circumstance, hearing, review, and collateral-attack rules may differ by circuit. | *United States v. D'Amario*, 412 F.3d 253, 255–56 (1st Cir. 2005): a pending revocation appeal does not remove the district court's continuing § 3583(e)(2) authority to modify conditions. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official First Circuit rules source](https://www.ca1.uscourts.gov/local-rules); no issue-specific local-rule absence is asserted. | Pending-appeal jurisdiction only; no early-termination, changed-circumstance, or universal hearing rule is inferred. | 2026-08-25 |
| Audita querela and other residual writs | The All Writs Act and Supreme Court limits supply the nationwide floor; any surviving elements test and remedial gap require current circuit authority. | *United States v. Holder*, 936 F.2d 1, 2–5 (1st Cir. 1991): if audita querela survives, it requires a later-arising legal objection unavailable through another remedy; pure equity is insufficient. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official First Circuit rules source](https://www.ca1.uscourts.gov/local-rules); no issue-specific local-rule absence is asserted. | Holder did not identify an actual gap or decide survival; current § 2255 and Jones v. Hendrix limits remain controlling. | 2026-08-26 |

## Application controls

1. Classify the judgment, custody source, motion, court, requested relief, and appellate posture before selecting an overlay row.
2. Use only a verified published circuit holding for a circuit proposition; do not promote a district opinion, unpublished disposition, dicta, or a party's characterization into binding law.
3. Run a current citator and check en banc, Supreme Court, statutory, rule, and local-rule changes before filing.
4. Preserve issue presentation, objections, the operative record, deadline trigger, and the governing standard of review.
5. If the issue register says `not_verified`, use the linked nationwide module only for its bounded nationwide proposition and obtain the missing controlling authority.
