# Fourth Circuit Overlay

This page prevents nationwide rules from being mistaken for Fourth Circuit doctrine and prevents unresearched circuit law from being guessed. It is a bounded overlay, not an exhaustive treatise or a substitute for the current docket, published opinions, local rules, or citator.

## Official rule source and currency

- [Official Fourth Circuit rules and procedures](https://www.ca4.uscourts.gov/LocalRules/LocalRules.pdf)
- Official rulebook dated December 1, 2025 checked on 2026-08-25.
- Source authority: `AUTH-CA4-LOCAL-RULES`.
- A portal check does not prove that no issue-specific local rule exists. Open the current rule, amendments, internal operating procedures, and standing orders for the actual filing.

## Verified circuit holdings

<!-- claim:CLM-CIR4-001 authorities:AUTH-CA4-DRAGENICE-389-F3D-92 status:verified_current -->
- **CLM-CIR4-001:** The Fourth Circuit recognizes administrative exhaustion as a judicial restraint that can make a § 2241 petition premature, but not as a jurisdictional prerequisite to the district court's habeas power. [*Dragenice v. Ridge*, 389 F.3d 92, 98 (4th Cir. 2004)](https://www.ca4.uscourts.gov/opinions/036717.P.pdf)

  Limitation: Binding only in the Fourth Circuit. Dragenice involved immigration detention and a pending removal proceeding, not the BOP Part 542 remedy program, so it does not establish BOP-specific steps or exceptions.
<!-- claim:CLM-CIR4-002 authorities:AUTH-PL-115-391-SEC-404,AUTH-SCOTUS-CONCEPCION-597-US-481,AUTH-CA4-REED-58-F4TH-816 status:verified_current -->
- **CLM-CIR4-002:** In the Fourth Circuit, § 404 does not require a reduction even when the existing sentence exceeds a revised statutory maximum, but the record must demonstrate that the district court considered every nonfrivolous argument presented; an ambiguous record can require vacatur and remand. [*United States v. Reed*, 58 F.4th 816, 819–23 (4th Cir. 2023)](https://www.ca4.uscourts.gov/opinions/197368.P.pdf)

  Limitation: Binding only in the Fourth Circuit. Reed recognizes that Concepcion displaced Collington's mandatory-reduction rule; it does not guarantee a reduction or make every sparse order reversible.
<!-- claim:CLM-CIR4-003 authorities:AUTH-USC-18-3582-3583,AUTH-CA4-MUHAMMAD-16-F4TH-126 status:verified_current -->
- **CLM-CIR4-003:** In the Fourth Circuit, § 3582(c)(1)(A)'s threshold requirement is nonjurisdictional and waived if not timely raised; after first asking the warden, a defendant may file upon full administrative exhaustion or 30 days after the warden's receipt, whichever occurs first, even if the warden denied the request during those 30 days. [*United States v. Muhammad*, 16 F.4th 126, 129–31 (4th Cir. 2021)](https://www.ca4.uscourts.gov/opinions/207520.P.pdf)

  Limitation: Binding only in the Fourth Circuit. Muhammad addresses the statutory filing gateway, not whether later judicial grounds must match the warden request or the merits of compassionate release.
<!-- claim:CLM-CIR4-004 authorities:AUTH-USC-18-3582-3583,AUTH-CA4-PREGENT-190-F3D-279 status:verified_current -->
- **CLM-CIR4-004:** In the Fourth Circuit, § 3583(e)(1) ordinarily authorizes a conduct-based inquiry and permits consideration of a broad range of interests-of-justice factors, but it is not a mechanism for collaterally attacking an original, unappealed sentence. [*United States v. Pregent*, 190 F.3d 279, 282–83 (4th Cir. 1999)](https://www.ca4.uscourts.gov/opinions/Published/986309.P.pdf)

  Limitation: Binding only in the Fourth Circuit. Pregent reviewed denial for abuse of discretion and did not create entitlement to termination whenever conduct and interests of justice favor relief; the original-sentence challenge belongs in the procedurally proper review vehicle.

## Circuit-sensitive issue register

Each row records the nationwide floor, the circuit rule actually verified or the exact missing source, intra-circuit conflict status, publication status, relevant local-rule source, inter-circuit comparison, current-split status, and the check date. “Not verified” is a stop condition, not an invitation to infer the rule.

| Issue | Supreme Court or nationwide floor | Fourth Circuit rule | Intra-circuit conflict | Publication status | Relevant local rule | Conflicting circuits / current split | Last checked |
|---|---|---|---|---|---|---|---|
| § 2241 administrative exhaustion | Section 2241 contains no general exhaustion clause; 28 C.F.R. part 542 defines the BOP remedy path. The character, waiver, and exceptions require controlling circuit law. | *Dragenice v. Ridge*, 389 F.3d 92, 98 (4th Cir. 2004): exhaustion can make § 2241 premature but is not jurisdictional; the case is immigration-habeas, not BOP Part 542. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Fourth Circuit rules source](https://www.ca4.uscourts.gov/LocalRules/LocalRules.pdf); no issue-specific local-rule absence is asserted. | Only the nonjurisdictional character is adopted; BOP-specific steps and exceptions remain posture dependent. | 2026-08-25 |
| COA for a federal § 2241 appeal | Section 2253(c) identifies the proceedings for which a COA is required; custody source and proceeding classification control. | Not verified: the current Fourth Circuit Rule 22 and unpublished federal-prisoner dispositions support the statutory reading, but the bounded public-source search did not locate an exact published precedential Fourth Circuit formulation. | No intra-circuit conflict established in this bounded review; absence is not asserted. | not_verified | [Official Fourth Circuit rules source](https://www.ca4.uscourts.gov/LocalRules/LocalRules.pdf); no issue-specific local-rule absence is asserted. | No controlling proposition is inferred from a local rule's silence, clerk guidance, or unpublished decisions. | 2026-08-25 |
| First Step Act § 404 procedure and review | Concepcion and § 404 supply the nationwide floor, but hearing, presence, explanation, preservation, and review rules may require circuit authority. | *United States v. Reed*, 58 F.4th 816, 819–23 (4th Cir. 2023): no mandatory reduction above a revised maximum; the record must show consideration of every nonfrivolous argument, and ambiguity can require remand. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Fourth Circuit rules source](https://www.ca4.uscourts.gov/LocalRules/LocalRules.pdf); no issue-specific local-rule absence is asserted. | Reed recognizes that Concepcion displaced Collington's mandatory-reduction rule. | 2026-08-25 |
| § 3582 issue presentation, reconsideration, and appeal | Section 3582(c), Rule 43, and Appellate Rule 4 supply text; issue exhaustion, reconsideration, waiver, and remedy remain posture- and circuit-sensitive. | *United States v. Muhammad*, 16 F.4th 126, 129–31 (4th Cir. 2021): nonjurisdictional and waivable; after a warden request, full exhaustion or 30 days, whichever is earlier, permits filing even after an early denial. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Fourth Circuit rules source](https://www.ca4.uscourts.gov/LocalRules/LocalRules.pdf); no issue-specific local-rule absence is asserted. | The rule concerns the statutory threshold, not issue exhaustion or compassionate-release merits. | 2026-08-25 |
| § 3583(e) modification and early termination | Section 3583(e) supplies eligibility, factors, and authorized actions; explanation, changed-circumstance, hearing, review, and collateral-attack rules may differ by circuit. | *United States v. Pregent*, 190 F.3d 279, 282–83 (4th Cir. 1999): broad conduct-and-interest-of-justice inquiry, but no collateral attack on the original unappealed sentence through § 3583(e)(1). | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Fourth Circuit rules source](https://www.ca4.uscourts.gov/LocalRules/LocalRules.pdf); no issue-specific local-rule absence is asserted. | No entitlement to termination is created; the proper direct or collateral review vehicle remains separate. | 2026-08-25 |
| Audita querela and other residual writs | The All Writs Act and Supreme Court limits supply the nationwide floor; any surviving elements test and remedial gap require current circuit authority. | Not verified: the bounded official and public-opinion search located only unpublished Fourth Circuit dispositions applying a no-other-remedy rule, not an exact published precedential federal-conviction holding. | No intra-circuit conflict established in this bounded review; absence is not asserted. | not_verified | [Official Fourth Circuit rules source](https://www.ca4.uscourts.gov/LocalRules/LocalRules.pdf); no issue-specific local-rule absence is asserted. | No binding proposition is inferred from In re Rushing-Floyd, Marty Wright, or other unpublished dispositions. | 2026-08-26 |

## Application controls

1. Classify the judgment, custody source, motion, court, requested relief, and appellate posture before selecting an overlay row.
2. Use only a verified published circuit holding for a circuit proposition; do not promote a district opinion, unpublished disposition, dicta, or a party's characterization into binding law.
3. Run a current citator and check en banc, Supreme Court, statutory, rule, and local-rule changes before filing.
4. Preserve issue presentation, objections, the operative record, deadline trigger, and the governing standard of review.
5. If the issue register says `not_verified`, use the linked nationwide module only for its bounded nationwide proposition and obtain the missing controlling authority.

## Coverage and limitations
