# Ninth Circuit Overlay

This page prevents nationwide rules from being mistaken for Ninth Circuit doctrine and prevents unresearched circuit law from being guessed. It is a bounded overlay, not an exhaustive treatise or a substitute for the current docket, published opinions, local rules, or citator.

## Official rule source and currency

- [Official Ninth Circuit rules and procedures](https://www.ca9.uscourts.gov/rules/)
- Official rules repository showing rules effective June 1, 2026 checked on 2026-08-25.
- Source authority: `AUTH-CA9-LOCAL-RULES`.
- A portal check does not prove that no issue-specific local rule exists. Open the current rule, amendments, internal operating procedures, and standing orders for the actual filing.

## Verified circuit holdings

<!-- claim:CLM-CIR9-001 authorities:AUTH-CA9-WARD-678-F3D-1042 status:verified_current -->
- **CLM-CIR9-001:** The Ninth Circuit treats ordinary § 2241 administrative exhaustion as prudential rather than jurisdictional and recognizes waiver when administrative pursuit would be futile. [*Ward v. Chavez*, 678 F.3d 1042, 1045–46 (9th Cir. 2012)](https://cdn.ca9.uscourts.gov/datastore/opinions/2012/05/08/09-17016.pdf)

  Limitation: Binding only in the Ninth Circuit and not a nationwide permission to bypass a claim-specific statutory exhaustion provision or the BOP record process.
<!-- claim:CLM-CIR9-002 authorities:AUTH-CA9-RODRIGUEZ-COPENHAVER-823-F3D-1238 status:verified_current -->
- **CLM-CIR9-002:** When BOP retained designation discretion but used an unlawful decision process, the Ninth Circuit ordered lawful reconsideration rather than the requested discretionary designation. [*Rodriguez v. Copenhaver*, 823 F.3d 1238, 1243 (9th Cir. 2016)](https://cdn.ca9.uscourts.gov/datastore/opinions/2016/05/25/14-16399.pdf)

  Limitation: Binding only in the Ninth Circuit and limited to the particular § 3621(b) process error; it does not establish a universal § 2241 remedy.
<!-- claim:CLM-CIR9-003 authorities:AUTH-USC-28-1651,AUTH-CA9-CARRINGTON-503-F3D-888 status:verified_current -->
- **CLM-CIR9-003:** In the Ninth Circuit, audita querela is a gap-filling writ and is unavailable for claims cognizable under § 2255; § 2255's successive-motion restrictions or nonretroactivity do not themselves create the required gap. [*Carrington v. United States*, 503 F.3d 888, 890 (9th Cir. 2007)](https://cdn.ca9.uscourts.gov/datastore/opinions/2007/09/11/0536143.pdf)

  Limitation: Binding only in the Ninth Circuit and not a nationwide elements test for audita querela.
<!-- claim:CLM-CIR9-004 authorities:AUTH-PL-115-391-SEC-404,AUTH-SCOTUS-CONCEPCION-597-US-481,AUTH-CA9-CARTER-44-F4TH-1227 status:verified_current -->
- **CLM-CIR9-004:** In the Ninth Circuit after Concepcion, a district court deciding a § 404 motion must consider the parties' nonfrivolous arguments based on intervening legal or factual developments and give a brief statement of reasons; an unexplained denial can require vacatur and remand. [*United States v. Carter*, 44 F.4th 1227, 1228–29 (9th Cir. 2022)](https://cdn.ca9.uscourts.gov/datastore/opinions/2022/08/17/19-10411.pdf)

  Limitation: Binding only in the Ninth Circuit. Carter recognizes that Concepcion abrogated Kelley's contrary intervening-change restriction; it does not require a reduction or a detailed point-by-point opinion.
<!-- claim:CLM-CIR9-005 authorities:AUTH-USC-28-2253,AUTH-CA9-CLOSE-653-F3D-970 status:verified_current -->
- **CLM-CIR9-005:** In the Ninth Circuit, a person in federal custody does not need a certificate of appealability to appeal the denial of a properly classified § 2241 petition. [*Close v. Thomas*, 653 F.3d 970, 974 n.2 (9th Cir. 2011)](https://cdn.ca9.uscourts.gov/datastore/opinions/2011/08/03/10-35850.pdf)

  Limitation: Binding only in the Ninth Circuit. Close involved federal BOP program-eligibility claims; the COA proposition does not decide § 2241 merits, state-process custody, § 2255, or filing classification.
<!-- claim:CLM-CIR9-006 authorities:AUTH-USC-18-3582-3583,AUTH-CA9-KELLER-2-F4TH-1278 status:verified_current -->
- **CLM-CIR9-006:** In the Ninth Circuit, § 3582(c)(1)(A)'s defendant-filing prerequisite is a mandatory claim-processing rule enforced when the government invokes it; a renewed motion based on changed circumstances required a new qualifying BOP request, and the filing defect was not cured by the passage of 30 days while the motion was pending. [*United States v. Keller*, 2 F.4th 1278, 1281–84 (9th Cir. 2021)](https://cdn.ca9.uscourts.gov/datastore/opinions/2021/07/01/20-50247.pdf)

  Limitation: Binding only in the Ninth Circuit and limited to a later motion premised on changed circumstances. Keller does not establish a universal issue-exhaustion test for every supplemental fact or argument.
<!-- claim:CLM-CIR9-007 authorities:AUTH-USC-18-3582-3583,AUTH-CA9-PONCE-22-F4TH-1045 status:verified_current -->
- **CLM-CIR9-007:** In the Ninth Circuit, § 3583(e)(1) does not impose a threshold requirement of exceptional or extraordinary circumstances, exceptionally good behavior, or undue hardship before a court may consider early termination. [*United States v. Ponce*, 22 F.4th 1045, 1047–49 (9th Cir. 2022)](https://cdn.ca9.uscourts.gov/datastore/opinions/2022/01/11/21-30009.pdf)

  Limitation: Binding only in the Ninth Circuit. Ponce remanded because the applied standard was unclear, did not hold compliance sufficient, and expressly did not reach the separate explanation challenge.

## Circuit-sensitive issue register

Each row records the nationwide floor, the circuit rule actually verified or the exact missing source, intra-circuit conflict status, publication status, relevant local-rule source, inter-circuit comparison, current-split status, and the check date. “Not verified” is a stop condition, not an invitation to infer the rule.

| Issue | Supreme Court or nationwide floor | Ninth Circuit rule | Intra-circuit conflict | Publication status | Relevant local rule | Conflicting circuits / current split | Last checked |
|---|---|---|---|---|---|---|---|
| § 2241 administrative exhaustion | Section 2241 contains no general exhaustion clause; 28 C.F.R. part 542 defines the BOP remedy path. The character, waiver, and exceptions require controlling circuit law. | *Ward v. Chavez*, 678 F.3d 1042, 1045–46 (9th Cir. 2012): prudential, nonjurisdictional, and waivable for futility. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Ninth Circuit rules source](https://www.ca9.uscourts.gov/rules/); no issue-specific local-rule absence is asserted. | Eleventh Circuit also treats the requirement as nonjurisdictional but describes enforcement differently; no exhaustive current split survey is claimed. | 2026-08-25 |
| COA for a federal § 2241 appeal | Section 2253(c) identifies the proceedings for which a COA is required; custody source and proceeding classification control. | *Close v. Thomas*, 653 F.3d 970, 974 n.2 (9th Cir. 2011): a person in federal custody does not need a COA to appeal denial of a § 2241 petition. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Ninth Circuit rules source](https://www.ca9.uscourts.gov/rules/); no issue-specific local-rule absence is asserted. | Federal BOP program-eligibility posture; no merits or classification proposition is inferred. | 2026-08-25 |
| First Step Act § 404 procedure and review | Concepcion and § 404 supply the nationwide floor, but hearing, presence, explanation, preservation, and review rules may require circuit authority. | *United States v. Carter*, 44 F.4th 1227, 1228–29 (9th Cir. 2022): consider nonfrivolous intervening legal or factual arguments and give a brief reason; an unexplained denial can require remand. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Ninth Circuit rules source](https://www.ca9.uscourts.gov/rules/); no issue-specific local-rule absence is asserted. | Carter recognizes Concepcion's abrogation of Kelley's contrary intervening-change restriction. | 2026-08-25 |
| § 3582 issue presentation, reconsideration, and appeal | Section 3582(c), Rule 43, and Appellate Rule 4 supply text; issue exhaustion, reconsideration, waiver, and remedy remain posture- and circuit-sensitive. | *United States v. Keller*, 2 F.4th 1278, 1281–84 (9th Cir. 2021): mandatory when invoked; a changed-circumstances renewed motion needed a new qualifying request, and waiting 30 days after filing did not cure prematurity. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Ninth Circuit rules source](https://www.ca9.uscourts.gov/rules/); no issue-specific local-rule absence is asserted. | No universal issue-exhaustion test is inferred for every supplement, fact, or legal argument. | 2026-08-25 |
| § 3583(e) modification and early termination | Section 3583(e) supplies eligibility, factors, and authorized actions; explanation, changed-circumstance, hearing, review, and collateral-attack rules may differ by circuit. | *United States v. Ponce*, 22 F.4th 1045, 1047–49 (9th Cir. 2022): no threshold exceptional-circumstance, exceptional-behavior, or undue-hardship requirement. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Ninth Circuit rules source](https://www.ca9.uscourts.gov/rules/); no issue-specific local-rule absence is asserted. | Ponce did not hold compliance sufficient and did not reach the separate explanation challenge. | 2026-08-25 |
| Audita querela and other residual writs | The All Writs Act and Supreme Court limits supply the nationwide floor; any surviving elements test and remedial gap require current circuit authority. | *Carrington v. United States*, 503 F.3d 888, 890 (9th Cir. 2007): gap filling only; § 2255 restrictions and nonretroactivity do not create a gap. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Ninth Circuit rules source](https://www.ca9.uscourts.gov/rules/); no issue-specific local-rule absence is asserted. | No exhaustive current inter-circuit survey completed. | 2026-08-26 |

## Application controls

1. Classify the judgment, custody source, motion, court, requested relief, and appellate posture before selecting an overlay row.
2. Use only a verified published circuit holding for a circuit proposition; do not promote a district opinion, unpublished disposition, dicta, or a party's characterization into binding law.
3. Run a current citator and check en banc, Supreme Court, statutory, rule, and local-rule changes before filing.
4. Preserve issue presentation, objections, the operative record, deadline trigger, and the governing standard of review.
5. If the issue register says `not_verified`, use the linked nationwide module only for its bounded nationwide proposition and obtain the missing controlling authority.

## Coverage and limitations

- Comprehensive commercial citator: **not run**.
- Individual docket, judgment, custody, and administrative record: **not reviewed**.
- Issue-specific local-rule absence: **not asserted**.
- Unverified rows are included in the coverage matrix and therefore the generated Jira backlog.
