# Tenth Circuit Overlay

This page prevents nationwide rules from being mistaken for Tenth Circuit doctrine and prevents unresearched circuit law from being guessed. It is a bounded overlay, not an exhaustive treatise or a substitute for the current docket, published opinions, local rules, or citator.

## Official rule source and currency

- [Official Tenth Circuit rules and procedures](https://www.ca10.uscourts.gov/clerk/rules)
- Official 2026 rules repository, with local rules effective January 1, 2026, checked on 2026-08-25.
- Source authority: `AUTH-CA10-LOCAL-RULES`.
- A portal check does not prove that no issue-specific local rule exists. Open the current rule, amendments, internal operating procedures, and standing orders for the actual filing.

## Verified circuit holdings

<!-- claim:CLM-CIR10-001 authorities:AUTH-CA10-GARZA-596-F3D-1198 status:verified_current -->
- **CLM-CIR10-001:** In the Tenth Circuit, exhaustion of available BOP remedies is a prerequisite to § 2241 relief despite the absence of an express statutory clause; a narrow futility exception exists, but alleged local categorical denial is insufficient where regional and national review remain available. [*Garza v. Davis*, 596 F.3d 1198, 1203–04 (10th Cir. 2010)](https://www.ca10.uscourts.gov/sites/ca10/files/opinions/01018368252.pdf)

  Limitation: Binding only in the Tenth Circuit and limited to the BOP placement posture. A prisoner cannot establish futility merely by styling the claim as a facial regulatory challenge, but materially different facts require separate analysis.
<!-- claim:CLM-CIR10-002 authorities:AUTH-PL-115-391-SEC-404,AUTH-SCOTUS-CONCEPCION-597-US-481,AUTH-CA10-MANNIE-971-F3D-1145 status:verified_current -->
- **CLM-CIR10-002:** In the Tenth Circuit, a § 404 proceeding is a sentence modification rather than a plenary resentencing; no hearing or defendant presence is categorically required, and the discretionary disposition is reviewed for abuse of discretion with enough reasoning to permit review. [*United States v. Mannie*, 971 F.3d 1145, 1155–58 (10th Cir. 2020)](https://www.ca10.uscourts.gov/sites/ca10/files/opinions/010110393562.pdf)

  Limitation: Binding only in the Tenth Circuit. Mannie's surviving nonplenary, hearing, presence, and review holdings are used; any pre-Concepcion restriction on intervening information is not adopted.
<!-- claim:CLM-CIR10-003 authorities:AUTH-USC-28-2253,AUTH-CA10-MCINTOSH-115-F3D-809 status:verified_current -->
- **CLM-CIR10-003:** In the Tenth Circuit, a federal prisoner appealing a final order in a properly classified § 2241 proceeding does not need a certificate of appealability. [*McIntosh v. U.S. Parole Commission*, 115 F.3d 809, 810 n.1 (10th Cir. 1997)](https://www.courtlistener.com/opinion/741840/marcus-allan-mcintosh-v-united-states-parole-commission/)

  Limitation: Binding only in the Tenth Circuit. McIntosh involved federal parole revocation; the proposition does not address state-process detention, § 2255, or whether a filing is properly classified under § 2241.
<!-- claim:CLM-CIR10-004 authorities:AUTH-USC-18-3582-3583,AUTH-CA10-HEMMELGARN-15-F4TH-1027 status:verified_current -->
- **CLM-CIR10-004:** In the Tenth Circuit, § 3582(c)(1)(A)'s defendant-filing prerequisite is a nonjurisdictional claim-processing rule that the government can waive or forfeit; when the government abandoned its exhaustion argument on appeal, the court proceeded to the merits. [*United States v. Hemmelgarn*, 15 F.4th 1027, 1030–31 (10th Cir. 2021)](https://www.ca10.uscourts.gov/sites/ca10/files/opinions/010110588266.pdf)

  Limitation: Binding only in the Tenth Circuit. Hemmelgarn does not decide issue exhaustion or create a judicial exception when the government timely preserves the filing defense; only its durable procedural holdings are adopted.
<!-- claim:CLM-CIR10-005 authorities:AUTH-USC-18-3582-3583,AUTH-FRCRIM-P-32-1,AUTH-CA10-BEGAY-631-F3D-1168 status:verified_current -->
- **CLM-CIR10-005:** In the Tenth Circuit, § 3583(e)(2) does not require changed circumstances before a district court may modify supervised-release conditions; the court must instead consider the listed factors, follow Rule 32.1, and ensure the new conditions satisfy the requirements applicable to supervised-release conditions. [*United States v. Begay*, 631 F.3d 1168, 1171–73 (10th Cir. 2011)](https://www.ca10.uscourts.gov/sites/ca10/files/opinions/01018581211.pdf)

  Limitation: Binding only in the Tenth Circuit. Begay addresses condition modification, not early termination, and does not dispense with factor consideration, Rule 32.1 procedure, or substantive limits on the modified condition.
<!-- claim:CLM-CIR10-006 authorities:AUTH-USC-28-1651,AUTH-USC-28-2255,AUTH-CA10-TORRES-282-F3D-1241 status:verified_current -->
- **CLM-CIR10-006:** In the Tenth Circuit, a federal prisoner cannot use audita querela to challenge a conviction or sentence when the claim is cognizable under § 2255; the substance of the filing controls and a custody-based collateral attack may be treated as a § 2255 motion subject to the applicable authorization rules. [*United States v. Torres*, 282 F.3d 1241, 1245–46 & n.6 (10th Cir. 2002)](https://storage.courtlistener.com/pdf/2002/02/21/United_States_vs._Torres.pdf)

  Limitation: Binding only in the Tenth Circuit. Torres assumed without deciding that audita querela might survive, distinguished coram nobis by custody, and tied notice before recharacterization to whether the filing would be the prisoner's first § 2255 motion.

## Circuit-sensitive issue register

Each row records the nationwide floor, the circuit rule actually verified or the exact missing source, intra-circuit conflict status, publication status, relevant local-rule source, inter-circuit comparison, current-split status, and the check date. “Not verified” is a stop condition, not an invitation to infer the rule.

| Issue | Supreme Court or nationwide floor | Tenth Circuit rule | Intra-circuit conflict | Publication status | Relevant local rule | Conflicting circuits / current split | Last checked |
|---|---|---|---|---|---|---|---|
| § 2241 administrative exhaustion | Section 2241 contains no general exhaustion clause; 28 C.F.R. part 542 defines the BOP remedy path. The character, waiver, and exceptions require controlling circuit law. | *Garza v. Davis*, 596 F.3d 1198, 1203–04 (10th Cir. 2010): exhaustion is a prerequisite; futility is narrow, and local categorical-denial allegations did not excuse higher review. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Tenth Circuit rules source](https://www.ca10.uscourts.gov/clerk/rules); no issue-specific local-rule absence is asserted. | Facial labeling alone did not excuse exhaustion; materially different facts require separate analysis. | 2026-08-25 |
| COA for a federal § 2241 appeal | Section 2253(c) identifies the proceedings for which a COA is required; custody source and proceeding classification control. | *McIntosh v. U.S. Parole Commission*, 115 F.3d 809, 810 n.1 (10th Cir. 1997): a federal prisoner does not need a COA to appeal a final order under § 2241. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Tenth Circuit rules source](https://www.ca10.uscourts.gov/clerk/rules); no issue-specific local-rule absence is asserted. | Federal-parole posture; no state-process, § 2255, or classification proposition is adopted. | 2026-08-25 |
| First Step Act § 404 procedure and review | Concepcion and § 404 supply the nationwide floor, but hearing, presence, explanation, preservation, and review rules may require circuit authority. | *United States v. Mannie*, 971 F.3d 1145, 1155–58 (10th Cir. 2020): § 404 is nonplenary sentence modification; no categorical hearing or presence right, abuse-of-discretion review, and a reasoned basis sufficient for review. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Tenth Circuit rules source](https://www.ca10.uscourts.gov/clerk/rules); no issue-specific local-rule absence is asserted. | Only surviving nonplenary, hearing, presence, and review propositions are adopted; Concepcion controls intervening information. | 2026-08-25 |
| § 3582 issue presentation, reconsideration, and appeal | Section 3582(c), Rule 43, and Appellate Rule 4 supply text; issue exhaustion, reconsideration, waiver, and remedy remain posture- and circuit-sensitive. | *United States v. Hemmelgarn*, 15 F.4th 1027, 1030–31 (10th Cir. 2021): nonjurisdictional claim-processing rule; the government's abandonment of exhaustion on appeal waived the defense. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Tenth Circuit rules source](https://www.ca10.uscourts.gov/clerk/rules); no issue-specific local-rule absence is asserted. | No issue-exhaustion or equitable-exception rule is adopted; only the durable procedural holding is used. | 2026-08-25 |
| § 3583(e) modification and early termination | Section 3583(e) supplies eligibility, factors, and authorized actions; explanation, changed-circumstance, hearing, review, and collateral-attack rules may differ by circuit. | *United States v. Begay*, 631 F.3d 1168, 1171–73 (10th Cir. 2011): condition modification does not require changed circumstances, but factors, Rule 32.1, and substantive condition limits remain. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Tenth Circuit rules source](https://www.ca10.uscourts.gov/clerk/rules); no issue-specific local-rule absence is asserted. | Condition modification only; no early-termination proposition is inferred. | 2026-08-25 |
| Audita querela and other residual writs | The All Writs Act and Supreme Court limits supply the nationwide floor; any surviving elements test and remedial gap require current circuit authority. | *United States v. Torres*, 282 F.3d 1241, 1245–46 & n.6 (10th Cir. 2002): a custody-based conviction or sentence challenge cognizable under § 2255 cannot proceed as audita querela and is classified by substance. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Tenth Circuit rules source](https://www.ca10.uscourts.gov/clerk/rules); no issue-specific local-rule absence is asserted. | Torres assumed survival only for argument and ties first-motion notice to the petitioner's prior § 2255 history. | 2026-08-26 |

## Application controls

1. Classify the judgment, custody source, motion, court, requested relief, and appellate posture before selecting an overlay row.
2. Use only a verified published circuit holding for a circuit proposition; do not promote a district opinion, unpublished disposition, dicta, or a party's characterization into binding law.
3. Run a current citator and check en banc, Supreme Court, statutory, rule, and local-rule changes before filing.
4. Preserve issue presentation, objections, the operative record, deadline trigger, and the governing standard of review.
5. If the issue register says `not_verified`, use the linked nationwide module only for its bounded nationwide proposition and obtain the missing controlling authority.
