# Third Circuit Overlay

This page prevents nationwide rules from being mistaken for Third Circuit doctrine and prevents unresearched circuit law from being guessed. It is a bounded overlay, not an exhaustive treatise or a substitute for the current docket, published opinions, local rules, or citator.

## Official rule source and currency

- [Official Third Circuit rules and procedures](https://www.ca3.uscourts.gov/rules-and-requirements)
- Official rules-and-requirements portal checked on 2026-08-25; linked instruments carry their own dates.
- Source authority: `AUTH-CA3-LOCAL-RULES`.
- A portal check does not prove that no issue-specific local rule exists. Open the current rule, amendments, internal operating procedures, and standing orders for the actual filing.

## Verified circuit holdings

<!-- claim:CLM-CIR3-001 authorities:AUTH-USC-28-2253,AUTH-CA3-BRUCE-868-F3D-170 status:verified_current -->
- **CLM-CIR3-001:** In the Third Circuit, 28 U.S.C. § 2253(c)'s certificate-of-appealability requirement did not apply to the federal prisoner's appeal from denial of a saving-clause § 2241 petition; that classification does not establish saving-clause availability on the merits. [*Bruce v. Warden Lewisburg USP*, 868 F.3d 170, 177 n.3 (3d Cir. 2017)](https://www2.ca3.uscourts.gov/opinarch/144284p.pdf)

  Limitation: Bruce's saving-clause merits analysis is limited by Jones v. Hendrix. This record uses only the published opinion's COA proposition and does not decide a state-process detention appeal or a § 2255 appeal.
<!-- claim:CLM-CIR3-002 authorities:AUTH-CA3-MOSCATO-98-F3D-757 status:verified_current -->
- **CLM-CIR3-002:** In the Third Circuit, federal prisoners ordinarily must exhaust administrative remedies before a § 2241 petition; a procedural default that closes the administrative path bars merits review unless the prisoner shows cause and prejudice. [*Moscato v. Federal Bureau of Prisons*, 98 F.3d 757, 760–62 (3d Cir. 1996)](https://www.courtlistener.com/opinion/728093/phillip-b-moscato-08126-050-v-federal-bureau-of-prisons-lsci/)

  Limitation: Binding only in the Third Circuit and limited to federal institutional discipline and a defaulted administrative appeal. It does not establish that every unexhausted filing is jurisdictionally barred.
<!-- claim:CLM-CIR3-003 authorities:AUTH-PL-115-391-SEC-404,AUTH-SCOTUS-CONCEPCION-597-US-481,AUTH-CA3-SHIELDS-48-F4TH-183 status:verified_current -->
- **CLM-CIR3-003:** In the Third Circuit, § 404 does not itself entitle a defendant to an in-person or plenary resentencing hearing, but the defendant must receive a reasonable opportunity to present written sentencing arguments, and the court must give enough explanation for meaningful appellate review. [*United States v. Shields*, 48 F.4th 183, 195–202 (3d Cir. 2022)](https://www2.ca3.uscourts.gov/opinarch/192717p.pdf)

  Limitation: Binding only in the Third Circuit. Shields does not create an entitlement to oral allocution or a plenary resentencing; its error finding turned on denying both a hearing and the requested opportunity for written sentencing submissions in the circumstances presented.
<!-- claim:CLM-CIR3-004 authorities:AUTH-USC-18-3582-3583,AUTH-CA3-RAIA-954-F3D-594 status:verified_current -->
- **CLM-CIR3-004:** In the Third Circuit, a defendant's § 3582(c)(1)(A) motion must be addressed first to the sentencing court; a motion made before 30 days elapsed and without completed administrative review was a roadblock that defeated first-instance appellate relief and made a limited remand futile. [*United States v. Raia*, 954 F.3d 594, 595–97 (3d Cir. 2020)](https://www2.ca3.uscourts.gov/opinarch/201033p.pdf)

  Limitation: Binding only in the Third Circuit and limited to Raia's unusual posture, where a government sentencing appeal was pending and the defendant asked the court of appeals to grant relief or remand. The claim does not rely on Raia's pandemic-specific merits observations or convert its procedural holding into a universal issue-exhaustion rule.
<!-- claim:CLM-CIR3-005 authorities:AUTH-USC-18-3582-3583,AUTH-CA3-MELVIN-978-F3D-49 status:verified_current -->
- **CLM-CIR3-005:** In the Third Circuit, § 3583(e)(1) does not require an exceptional, extraordinary, new, or unforeseen circumstance before early termination may be granted, although changed circumstances may often be relevant to the discretionary assessment. [*United States v. Melvin*, 978 F.3d 49, 52–53 (3d Cir. 2020)](https://www2.ca3.uscourts.gov/opinarch/201158p.pdf)

  Limitation: Binding only in the Third Circuit. Melvin disavows a threshold prerequisite but does not guarantee relief for compliance, eliminate factor consideration, or prescribe the result on remand.
<!-- claim:CLM-CIR3-006 authorities:AUTH-USC-28-1651,AUTH-USC-28-2255,AUTH-CA3-MASSEY-581-F3D-172 status:verified_current -->
- **CLM-CIR3-006:** In the Third Circuit, the All Writs Act is residual and cannot displace § 2255: a federal-sentence claim cognizable under § 2255 cannot be recast as audita querela, and prior use of § 2255 or the successive-motion gate does not create a gap. [*Massey v. United States*, 581 F.3d 172, 174 (3d Cir. 2009) (per curiam)](https://www.courtlistener.com/opinion/1266166/massey-v-united-states/)

  Limitation: Binding only in the Third Circuit. Massey involved a Booker sentencing claim by a prisoner who had already pursued § 2255; it does not establish that audita querela survives or define relief outside § 2255's field.

## Circuit-sensitive issue register

Each row records the nationwide floor, the circuit rule actually verified or the exact missing source, intra-circuit conflict status, publication status, relevant local-rule source, inter-circuit comparison, current-split status, and the check date. “Not verified” is a stop condition, not an invitation to infer the rule.

| Issue | Supreme Court or nationwide floor | Third Circuit rule | Intra-circuit conflict | Publication status | Relevant local rule | Conflicting circuits / current split | Last checked |
|---|---|---|---|---|---|---|---|
| § 2241 administrative exhaustion | Section 2241 contains no general exhaustion clause; 28 C.F.R. part 542 defines the BOP remedy path. The character, waiver, and exceptions require controlling circuit law. | *Moscato v. Federal Bureau of Prisons*, 98 F.3d 757, 760–62 (3d Cir. 1996): ordinary exhaustion is required; a closed administrative path caused by procedural default requires cause and prejudice. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Third Circuit rules source](https://www.ca3.uscourts.gov/rules-and-requirements); no issue-specific local-rule absence is asserted. | Cause-and-prejudice rule addresses procedural default; no jurisdictional characterization is inferred. | 2026-08-25 |
| COA for a federal § 2241 appeal | Section 2253(c) identifies the proceedings for which a COA is required; custody source and proceeding classification control. | *Bruce v. Warden Lewisburg USP*, 868 F.3d 170, 177 n.3 (3d Cir. 2017): no COA for the federal saving-clause § 2241 appeal. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Third Circuit rules source](https://www.ca3.uscourts.gov/rules-and-requirements); no issue-specific local-rule absence is asserted. | No saving-clause merits proposition is inferred from the COA footnote. | 2026-08-25 |
| First Step Act § 404 procedure and review | Concepcion and § 404 supply the nationwide floor, but hearing, presence, explanation, preservation, and review rules may require circuit authority. | *United States v. Shields*, 48 F.4th 183, 195–202 (3d Cir. 2022): no entitlement to an in-person or plenary hearing, but a reasonable opportunity for written sentencing arguments and a reviewable explanation are required. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Third Circuit rules source](https://www.ca3.uscourts.gov/rules-and-requirements); no issue-specific local-rule absence is asserted. | The error finding was tied to the combined denial of a hearing and requested written sentencing submissions in the circumstances presented. | 2026-08-25 |
| § 3582 issue presentation, reconsideration, and appeal | Section 3582(c), Rule 43, and Appellate Rule 4 supply text; issue exhaustion, reconsideration, waiver, and remedy remain posture- and circuit-sensitive. | *United States v. Raia*, 954 F.3d 594, 595–97 (3d Cir. 2020): the sentencing court acts first; a premature filing was a roadblock that defeated first-instance appellate relief and made remand futile. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Third Circuit rules source](https://www.ca3.uscourts.gov/rules-and-requirements); no issue-specific local-rule absence is asserted. | Unusual pending-government-appeal posture; no general issue-exhaustion proposition or pandemic merits rule is adopted. | 2026-08-25 |
| § 3583(e) modification and early termination | Section 3583(e) supplies eligibility, factors, and authorized actions; explanation, changed-circumstance, hearing, review, and collateral-attack rules may differ by circuit. | *United States v. Melvin*, 978 F.3d 49, 52–53 (3d Cir. 2020): exceptional, extraordinary, new, or unforeseen circumstances are not a prerequisite to early termination. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Third Circuit rules source](https://www.ca3.uscourts.gov/rules-and-requirements); no issue-specific local-rule absence is asserted. | Changed circumstances may remain relevant and ordinary compliance does not compel relief. | 2026-08-25 |
| Audita querela and other residual writs | The All Writs Act and Supreme Court limits supply the nationwide floor; any surviving elements test and remedial gap require current circuit authority. | *Massey v. United States*, 581 F.3d 172, 174 (3d Cir. 2009): the All Writs Act is residual; a claim cognizable under § 2255 cannot use audita querela, and the successive-motion gate creates no gap. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Third Circuit rules source](https://www.ca3.uscourts.gov/rules-and-requirements); no issue-specific local-rule absence is asserted. | The opinion does not establish survival or define relief outside § 2255's field. | 2026-08-26 |

## Application controls

1. Classify the judgment, custody source, motion, court, requested relief, and appellate posture before selecting an overlay row.
2. Use only a verified published circuit holding for a circuit proposition; do not promote a district opinion, unpublished disposition, dicta, or a party's characterization into binding law.
3. Run a current citator and check en banc, Supreme Court, statutory, rule, and local-rule changes before filing.
4. Preserve issue presentation, objections, the operative record, deadline trigger, and the governing standard of review.
5. If the issue register says `not_verified`, use the linked nationwide module only for its bounded nationwide proposition and obtain the missing controlling authority.
