Eighth Circuit Overlay
This page prevents nationwide rules from being mistaken for Eighth Circuit doctrine and prevents unresearched circuit law from being guessed. It is a bounded overlay, not an exhaustive treatise or a substitute for the current docket, published opinions, local rules, or citator.

Verified circuit holdings
- CLM-CIR8-001: In the Eighth Circuit, a prisoner challenging the BOP's execution of a federal sentence must first present the claim to the BOP; failure to request the available BOP designation required dismissal of the § 2241 petition without prejudice. Mathena v. United States, 577 F.3d 943, 946 (8th Cir. 2009)
Limitation: Binding only in the Eighth Circuit and limited to the available nunc pro tunc designation process in the sentence-execution posture. No general exception rule is inferred.
- CLM-CIR8-002: In the Eighth Circuit, eligibility under § 404 is reviewed de novo and the grant or denial of an eligible motion is reviewed for abuse of discretion; the First Step Act does not require a hearing on the motion. United States v. McDonald, 944 F.3d 769, 771–72 (8th Cir. 2019)
Limitation: Binding only in the Eighth Circuit. McDonald's no-hearing and review holdings survive as bounded propositions; any pre-Concepcion restriction on intervening information is not adopted.
- CLM-CIR8-003: In the Eighth Circuit, the certificate-of-appealability requirement does not apply to a federal prisoner effectively filing under § 2241. Langella v. Anderson, 612 F.3d 938, 939 n.2 (8th Cir. 2010)
Limitation: Binding only in the Eighth Circuit. Langella involved federal parole detention; no rule is adopted for state-process custody, § 2255, or disputed classification of a mislabeled filing.
- CLM-CIR8-004: In the Eighth Circuit, § 3582(c)(1)(A)'s filing prerequisite is a mandatory claim-processing rule that must be enforced when properly raised; an unexhausted motion is dismissed without prejudice, and asserted futility based on the Attorney General's home-confinement memorandum did not excuse the missing request. United States v. Houck, 2 F.4th 1082, 1084–85 (8th Cir. 2021)
Limitation: Binding only in the Eighth Circuit. Houck's futility holding is limited to the theory actually presented; compassionate release and BOP home-confinement placement remain distinct remedies.
- CLM-CIR8-005: In the Eighth Circuit, Rule 32.1(c)(1) does not require counsel or a hearing before a court denies a motion to terminate supervision or modify conditions, and § 3583(e) does not require a separate explanation for denial when the existing record makes the court's basis discernible. United States v. Norris, 62 F.4th 441, 445–51 (8th Cir. 2023)
Limitation: Binding only in the Eighth Circuit and limited to denial. Rule 32.1 ordinarily requires a hearing and counsel before an actual condition modification unless an enumerated exception applies; Norris does not authorize an unexplained denial when the record supplies no discernible basis.
Circuit-sensitive issue register
Each row records the nationwide floor, the circuit rule actually verified or the exact missing source, intra-circuit conflict status, publication status, relevant local-rule source, inter-circuit comparison, current-split status, and the check date. “Not verified” is a stop condition, not an invitation to infer the rule.
| Issue | Supreme Court or nationwide floor | Eighth Circuit rule | Intra-circuit conflict | Publication status | Relevant local rule | Conflicting circuits / current split | Last checked |
|---|---|---|---|---|---|---|---|
| § 2241 administrative exhaustion | Section 2241 contains no general exhaustion clause; 28 C.F.R. part 542 defines the BOP remedy path. The character, waiver, and exceptions require controlling circuit law. | Mathena v. United States, 577 F.3d 943, 946 (8th Cir. 2009): a BOP sentence-execution claim must first be presented to BOP; failure required dismissal without prejudice. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | Official Eighth Circuit rules source; no issue-specific local-rule absence is asserted. | The opinion does not supply a general exception taxonomy. | 2026-08-25 |
| COA for a federal § 2241 appeal | Section 2253(c) identifies the proceedings for which a COA is required; custody source and proceeding classification control. | Langella v. Anderson, 612 F.3d 938, 939 n.2 (8th Cir. 2010): the COA requirement does not apply to a federal prisoner effectively filing under § 2241. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | Official Eighth Circuit rules source; no issue-specific local-rule absence is asserted. | Federal-parole posture; no state-process, § 2255, or disputed-classification proposition is adopted. | 2026-08-25 |
| First Step Act § 404 procedure and review | Concepcion and § 404 supply the nationwide floor, but hearing, presence, explanation, preservation, and review rules may require circuit authority. | United States v. McDonald, 944 F.3d 769, 771–72 (8th Cir. 2019): eligibility is reviewed de novo, discretionary grant or denial for abuse of discretion, and the Act does not require a hearing. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | Official Eighth Circuit rules source; no issue-specific local-rule absence is asserted. | Only the no-hearing and standards-of-review holdings are adopted; Concepcion controls intervening information. | 2026-08-25 |
| § 3582 issue presentation, reconsideration, and appeal | Section 3582(c), Rule 43, and Appellate Rule 4 supply text; issue exhaustion, reconsideration, waiver, and remedy remain posture- and circuit-sensitive. | United States v. Houck, 2 F.4th 1082, 1084–85 (8th Cir. 2021): mandatory when raised; dismiss without prejudice, and the asserted home-confinement-memorandum futility theory did not excuse the missing request. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | Official Eighth Circuit rules source; no issue-specific local-rule absence is asserted. | The futility holding is posture specific; compassionate release and BOP home-confinement placement are distinct remedies. | 2026-08-25 |
| § 3583(e) modification and early termination | Section 3583(e) supplies eligibility, factors, and authorized actions; explanation, changed-circumstance, hearing, review, and collateral-attack rules may differ by circuit. | United States v. Norris, 62 F.4th 441, 445–51 (8th Cir. 2023): Rule 32.1(c)(1) does not require counsel or a hearing before denial, and a separate explanation is unnecessary when the record makes the basis discernible. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | Official Eighth Circuit rules source; no issue-specific local-rule absence is asserted. | Actual condition modification ordinarily triggers Rule 32.1; a record with no discernible basis is not approved. | 2026-08-25 |
| Audita querela and other residual writs | The All Writs Act and Supreme Court limits supply the nationwide floor; any surviving elements test and remedial gap require current circuit authority. | Not verified: Boal mentions an audita-querela petition, but the petition was dismissed below and that dismissal was not challenged on appeal; no exact published Eighth Circuit availability or § 2255-gap holding was located. | No intra-circuit conflict established in this bounded review; absence is not asserted. | not_verified | Official Eighth Circuit rules source; no issue-specific local-rule absence is asserted. | No rule is inferred from Boal's descriptive footnote or from district decisions stating that the Eighth Circuit had not resolved the question. | 2026-08-26 |
Application controls
- Classify the judgment, custody source, motion, court, requested relief, and appellate posture before selecting an overlay row.
- Use only a verified published circuit holding for a circuit proposition; do not promote a district opinion, unpublished disposition, dicta, or a party's characterization into binding law.
- Run a current citator and check en banc, Supreme Court, statutory, rule, and local-rule changes before filing.
- Preserve issue presentation, objections, the operative record, deadline trigger, and the governing standard of review.
- If the issue register says
not_verified, use the linked nationwide module only for its bounded nationwide proposition and obtain the missing controlling authority.
